My favorite film is Judgment at Nuremberg, and the defense counsel, defending Nazi judges, makes a very strong logical case. At the end, the lead judge tells him, "You were particularly brilliant in your use of logic; but to be logical is not to be right." When dealing with the pro-choice group as a whole and organizations such as ACLU, we have become a society of "your ideas are okay as long as they are just like mine." I certainly hope you are correct in your legal analysis and ACLU really doesn't have a leg to stand on, but given a decision last year which forced Catholic Adoption Agencies to give children to homosexual couples (and thereby forced them to close their doors), I don't have a great deal of hope that this case will be dropped.
